Trans-Nomad is a package trip that, in addition to the competitive event, offers services included in the registration for participants such as accommodation, transport, and other complementary services.
The package trip with accommodation and transport is provided by the travel agency Trans-Nomad Enduro Base Camp Adventure, registered under the name Trans-Nomad SL, with its registered office at Plaza Unidad Nacional, 7, 7 b, 22001 (Huesca), CIF B94148897. It is registered in the Aragon Tourism Registry with identification code CAA 430 and complies with current regulations.
These General Conditions are subject to the provisions of the Revised Text of the General Law for the Defense of Consumers and Users and other complementary laws (Royal Legislative Decree 1/2007, of November 16; B.O.E. 30-11-2007), Law 7/1998, of April 13 on General Contracting Conditions (14-4-98), and other current provisions.
These General Conditions will be incorporated, signed by the contracting parties, into all package trip contracts whose object is the programs/offers contained in the program/brochure and are binding on the parties, with the specific conditions agreed upon in the contract or stated in the trip documentation provided simultaneously with the signing of the contract.
Non-refundable expenses are considered to be all those derived from advances made by the event organization to suppliers, such as accommodation, food, transport, and material goods, services, and minimum management expenses necessary for holding the event. In this case, they must be fully assumed by the traveler and may represent up to 25% of the total registration fee.
Registrations are nominal and cannot be transferred to other riders without the organization’s authorization. In the event that a participant cannot attend the event for various reasons (medical, family, etc.), the cancellation policy is as follows:
Participants have cancellation insurance included in their registration, which includes a 100% refund of the registration fee for the causes stipulated in the policy, including sick leave, medical reasons, and other extraordinary circumstances. For other situations not included in the cancellation policy, there is no refund from the organization.
In case of withdrawal by a rider, the amount paid will not be refunded; however, the rider may continue to use the facilities and all contracted services until the end of the event.
Except for injury, a rider may only withdraw at the end of a section and must notify the person in charge of that section to inform the race organization. From the aid station, accessible by vehicle, the rider’s return to the accommodation will be managed.
The organization reserves the right to cancel the event, or any of the days or competitive sections, due to weather conditions that endanger the riders, or for technical reasons or emergencies beyond the organization’s control.
Communication regarding the cancellation of stages will be made at the 8:00 PM briefing each day prior to the next day’s stage.
The organization may cancel the event due to force majeure, and registered participants will be entitled to a refund of the amounts paid, except for management fees and expenses communicated as non-refundable (payments for certain accommodations, transport, materials, etc.).
In this case, a written communication will be sent to the email address provided during registration, explaining the reasons for the cancellation and the non-refundable expenses.
In no case will the cancellation of the event imply a refund of a sum higher than the cost of the event, nor will it generate an obligation for the organizer to provide compensation.
The Package Trip Contract generated by the registration is governed by the agreement between the parties, these General Conditions, and the provisions of Royal Legislative Decree 1/2007 of November 16.
Trans-Nomad SL is not party to any consumer arbitration system.
In the case of administrative claims, they must be filed through the Diputación General de Huesca, the competent body in tourism matters, given that Trans-Nomad SL’s registered office is in Huesca.
Legal actions derived from the Package Trip Contract expire within two years starting from the day the trip ends; express submission to the jurisdiction of the courts of Huesca.
Trans-Nomad’s liability for material damage or injury is regulated according to the described international agreements. Such liability shall never exceed the limits established in international agreements and regulations.
Trans-Nomad has a civil liability insurance policy, adapted to the requirements of the Autonomous Community of Aragon for travel agency activities. Trans-Nomad cannot be held responsible, under any circumstances, for damages caused by the unauthorized action of the client, nor for damages caused by third parties, natural disasters, or events over which Trans-Nomad has no influence (including strikes, schedule changes, etc.).
Within the framework of a company’s duty to exercise due caution, Trans-Nomad SL can only be held responsible for the conscientious preparation of the trip, the careful selection and supervision of service providers, the accuracy of the service description, and the correct provision of services as per the contract. Trans-Nomad is not responsible for non-compliance by service providers.
The Trans-Nomad staff does not own or operate any entity that provides or will provide products or services for the trip. It contracts transport (buses, vans, etc.), accommodation, restaurants, transfers, and other services from various independent providers. All these persons and entities are independent contractors. Consequently, Trans-Nomad SL is not responsible for any negligent or willful act of said person or entity or those of third parties.
Furthermore, and without limitation, Trans-Nomad is not responsible for any injury, loss, death, inconvenience, delay, or damage to personal property in connection with the provision of products or services resulting from force majeure, illness, acts of war, civil unrest, insurrection or revolution, animals, strikes and other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failures of aircraft or other modes of transport, or the untimely arrival or departure of any means of transport.
